- PREAMBLE AND BINDING ACCEPTANCE
1.1. Introduction:
These Terms and Conditions ("Terms," "Agreement") constitute a legally binding contract between you, an individual user or entity ("User," "you," "your"), and Nexora Finance Group, a proprietorship firm registered and operating under the laws of India ("Firm”, "we," "us," "our"). This Agreement governs your access to and use of the services provided through our website [www.nexorafinancegroup.com) (hereinafter referred to as the "Site").
By accessing the Site, initiating and completing the registration process, and payment of the Service Fee, the Individual affirms that the Individual has read, fully understood, and agrees unequivocally to be bound by all clauses within this Agreement and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must immediately cease any or all usage of the Site and our services.
- DEFINITIONS
2.1. "Service":
Refers to the loan facilitation and lead generation service provided by the Firm, which consists solely of collecting a User's Personal Information and transmitting it to a trusted network of Financial Partners.
2.2. "Lending Service Provider (LSP)":
The role of the Firm as an intermediary performing customer acquisition functions on behalf of Regulated Entities, as defined under the RBI's Digital Lending Directions.
2.3. "Financial Partners":
A network of independent, third-party, RBI-regulated entities, including Banks and Non-Banking Financial Companies (NBFCs), with whom we have contractual arrangements.
2.4. "Personal Information":
As defined in our Privacy Policy, including your full legal name, contact details, Permanent Account Number (PAN) and AADHAR information.
2.5. "Service Fee":
The non-refundable consideration of INR 360/- payable by the User for availing the Service.
- SCOPE AND NATURE OF THE SERVICE
3.1. Company's Role:
The Firm operates exclusively as a Lending Service Provider (LSP). Our role is strictly limited to that of a digital intermediary. We do not provide, underwrite, or service loans. Servicing of loans is at the sole discretion of our Financial Partners, subject to their satisfaction.
3.2. Service Provided:
Our Service is the executive process of collecting your registration details and securely forwarding them to our Financial Partners to enable their independent assessment of your eligibility for their respective loan products.
3.3. Express Exclusions:
The Firm expressly does not: (a) Engage in any lending activity; (b) Make any credit decision or assess creditworthiness; (c) Guarantee that a loan will be granted by our Financial Partner / Partners; (d) Control the Annual Percentage Rate (APR) or other loan terms; (e) Act as an agent for the User.
- USER ELIGIBILITY, REPRESENTATIONS, AND COVENANTS
4.1. Eligibility:
User must be: (a) A citizen and resident of India; (b) At least 18 years of age and legally competent to contract.
4.2. User Covenants:
User represents, warrants and acknowledges that: (a) All information provided by User is true, accurate, current, and complete; (b) User is not impersonating any other person; (c) User will maintain the accuracy of such information; (d) User’s use of the Service is for a lawful and a bona fide purpose.
- SERVICE FEE, PAYMENT, AND NO-REFUND POLICY
5.1. Service Fee:
A payment of one-time, non-refundable and non-cancellable Service Fee of Rs. 360/- (Rupees Three Hundred and Sixty only) is mandatory to avail the Service.
5.2. Purpose Acknowledgment:
You explicitly acknowledge that this one-time fee of Rs. 360/- is only a consideration only for the executive service of data processing and transmission, and the same should not be considered as a loan application fee.
5.3. Completion of Service:
Our service obligation is deemed fully discharged upon successful payment of the one-time Service Fee.
5.4. No Refund:
As detailed in our Refund and Cancellation Policy, the one-time Service Fee is strictly non-refundable, including in the event of loan rejection, subject to the sole exception which has been detailed in our Refund and Cancellation Policy.
- PROHIBITED USES AND ACTIVITIES
User agrees not to use the Site or Service for any unlawful purpose. You are expressly prohibited from:
a) Systematically retrieving data to create a collection, database, or directory without our written permission and / or authorization.
b) Using any automated system, including scripts, bots, or data mining tools.
c) Attempting to defraud or mislead us or other users to gain access to sensitive information. Such a malicious attempt could disbar the User from using our Services permanently.
d)Using the Service to compete with us or for any commercial gains.
- e) Trying to establish contact with any of our other Users with a mala fide intent of obtaining information which do not cater to the requirement of the concerned User.
e) Harassing, intimidating, or threatening any of our employees, men or agents
f) Attempting to bypass any security measures of the Site.
- PROCESS FLOW AND THIRD-PARTY INTERACTION
7.1. Data Transmission:
Upon registration with the payment of one-time fees of Rs. 360/-, User’s Personal Information will be shared with our network of Financial Partners.
7.2. Direct Contact Consent:
User expressly consents to be contacted directly by these Financial Partners via telephone, SMS, email, and/or WhatsApp or through any other electronic mode of contact.
7.3. Independent Relationship:
Any agreement that the User enters into with a Financial Partner is entirely independent and outside the scope of terms and conditions of the Firm.
7.4. Third-Party Terms:
It is the User’s sole responsibility to review and understand the terms and conditions of our Financial Partners before entering into any agreement with them.
- INTELLECTUAL PROPERTY RIGHTS
All contents on the Site, including text, graphics, logos, and software are the exclusive property of Nexora Finance Group and is protected by copyright and trademark laws. Unauthorized use is strictly prohibited and is punishable under the relevant laws in force as on date.
- DISCLAIMER OF WARRANTIES
THE SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE FIRM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO GUARANTEE THAT OUR SERVICE WILL POSITIVELY RESULT IN A LOAN OFFER FROM OUR CONTRACTUAL LENDING PARTNERS.
- LIMITATION OF LIABILITY
10.1. Indirect Damages:
IN NO EVENT SHALL THE FIRM BE LIABLE FOR ANY INDIRECT, REMOTE, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE PECUNIARY DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE PROVIDED BY US.
10.2. Direct Damages:
OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT OF THE ONE-TIME SERVICE FEE PAID BY YOU (I.E., RS. 360/-).
10.3. Scope:
This limitation applies to any damages arising from any failure of performance, error, omission, or other cause of action.
- INDEMNIFICATION
User agrees to defend, indemnify, and hold harmless Nexora Finance Group and its officers, directors, and employees from any and all claims, damages, liabilities, costs, or debt (including attorney's fees) arising from: (a) User’s use of the Service provided by us; (b) User’s violation of these Terms and Conditions; (c) User’s violation of any third-party right.
- TERMS AND TERMINATION
These Terms and Conditions shall remain in full force and effect while User uses the Site. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE, DENY ACCESS TO AND USE OF THE SITE TO ANY PERSON FOR ANY REASON, INCLUDING FOR BREACH OF ANY REPRESENTATION OR WARRANTY CONTAINED HEREIN.
- MODIFICATION OF TERMS
We reserve the right to modify and / or alter and / or change these Terms and Conditions at any time. We will alert User to effective changes by updating the "Last Updated" date. User, hereby, waives any right to receive specific notice of each change. User’s continued use of the Site after such effective changes constitutes complete acceptance of the new Terms.
- FORCE MAJEURE
The Firm shall not be liable for any failure to perform its obligations hereunder wherein such failure results from any cause and / or causes which are beyond our reasonable control or knowledge, including, but not limited to, acts of God, war, riots, strikes, governmental action, or electronic failures.
- GOVERNING LAW AND DISPUTE RESOLUTION
15.1. Governing Law:
This Agreement shall be governed by the relevant laws in force of the Republic of India.
15.2. Jurisdiction:
Any legal action shall be brought exclusively in the competent courts of Kolkata, West Bengal.
- MISCELLANEOUS
16.1. Severability:
If any provision of this Agreement is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force.
16.2. Entire Agreement:
This Agreement, together with the Privacy Policy and Refund Policy, constitutes the entire agreement between the User and the Firm.
16.3. No Waiver:
Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

PRIVACY POLICY:
- INTRODUCTION AND COMMITMENT TO PRIVACY
Nexora Finance Group ("Firm," "we," "us," "our") is a proprietorship firm registered in India, which operates through the website being
www.nexorafinancegroup.com (hereinafter referred to as "Site") and is engaged in the business of loan facilitation services as a Lending Service Provider (hereinafter referred to as “LSP”) for our regulated lending partners (hereinafter referred to as “Lenders”). We are committed to protecting the privacy and security of the personal data of our users (“Individual”, "User," "you," "your").
This Privacy Policy (hereinafter referred to as "Policy") provides a detailed account of our practices and procedures regarding the collection, use, processing, storage, disclosure, and protection of your personal information. This Policy explains how we collect, use, process, disclose and safeguard your personal data while using our site and our curated loan facilitation services (hereinafter collectively referred to as “Services”).We are committed to protecting your privacy and ensuring the security of your personal data in compliance with the Digital Personal Data Protection Act 2023 including the Information Technology Act, 2000, and its rules, specifically the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and other applicable Indian laws and regulatory guidelines issued by the Reserve Bank of India from time to time.
By accessing our Site and voluntarily providing your personal data and information, an Individual affirms his / her explicit and informed consent to the terms outlined in this Policy.
- DEFINITIONS
- "Personal Data" means any information and / or data that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with us, is capable of identifying such person.
- "Sensitive Personal Data or Information" (hereinafter referred to as “SPDI”) includes information such as passwords, financial information (like Bank account, credit card, debit card, or other payment instrument details), and any other information deemed sensitive under the IT Rules, 2011. Your Permanent Account number is treated with the same level of security as SPDI.
- "Financial Partners" refers to the network of regulated entities, including Banks and Non-Banking Financial Companies (NBFCs), with whom we have partnered.
- “Data Principal” refers to the user and / or the individual herein whose sensitive and personal data is processed.
- “Data Fiduciary” refers to the entity which determines the loan processing purpose, which is often our lending partner or us.
- “Data Processor” refers to an entity which processes data on behalf of a data fiduciary.
- “Consent” refers to a clear and specific indication of the User’s agreement with the terms and policies of this proprietorship firm.
- “Individual” refers to the person who uses and accesses our site to avail credit facilities from lending institutions and / or financial partners.
- WHAT INFORMATION / DATA WE COLLECT (DATA MINIMIZATION PRINCIPLE)
We adhere to the principle of data minimization and collect only the information that is strictly necessary to provide our services of loan facilitation, adhering to Reserve Bank of India guidelines and the DPDP Act. Upon registration, we collect the following Personal Information:
- Personal Identification Data: Such as full name, date of birth, Permanent Account Number of the Individual and AADHAR details. Such details so obtained from the Individual may be used for KYC confirmation by us or our Lenders.
- Financial & Credit Information: Including bank details, income details and credit reports from Credit Information Companies.
- Employment Details: Information about Individual’s occupation, name of Employer and place of employment.
- Contact Data: A verifiable mobile phone number and a valid email address.
We specifically state that we do not access Individual’s mobile phone resources like contact lists or media. Camera, microphone or location access for a one-time KYC may be requested with Individual’s prior consent. We do not store biometric data.

- HOW DO WE COLLECT YOUR INFORMATION:
Required information of the Individual’s private information is collected through:
- Directly from the Individual – When Individual uses or accesses our online site or communicate with us.
- From Third Parties – Including our lending partners, credit information companies and other service providers.
- Automated means – Via cookies and similar technologies for data / information usage.
- LEGAL BASIS AND PURPOSE OF DATA COLLECTION AND PROCESSING
Our legal basis for collecting and processing Individual’s Personal Information is that individual’s
explicit consent, provided at the time of registration. The information is collected for the sole and specific purpose of:
- Facilitating Loan Inquiries: To act as a service provider by securely transmitting Individual’s Identity, Contact, and Financial Data to our Financial Partners to enable them to process applications, assess Individual’s creditworthiness, verify identity, eligibility for loan products and facilitate credit disbursal.
- Legal & Regulatory Compliance: To meet the regulatory requirements from RBI and compliance under PMLA Act and DPDP Act and to respond to legal requests, if any.
- Enabling Communication: To allow our Financial Partners to communicate with the Individual directly regarding your loan inquiry.
- Internal Record Keeping: For maintaining records as required by law and for internal administrative purposes.
- Service Improvement: To analyse usage of our services and enhance the efficiency and timely delivery of our services.
- Fraud Prevention: To detect and prevent fraudulent activities.
We will not use Individual’s Personal Information for any purpose other than that for which Individual’s explicit consent has been obtained.
- CONSENT MECHANISM
Individual’s consent is obtained through a clear affirmative action. Before you submit your information and make the one-time registration payment of Rs. 360/- (Rupees Three Hundred Sixty only), Individual will be required to check a box that explicitly states:
"I have read and agree to the Terms and Conditions and the Privacy Policy. I hereby provide my explicit consent to Nexora Finance Group to collect, process, and share my Name, Email, Phone Number, and PAN with its network of banks and NBFCs for the purpose of evaluating my eligibility for a loan."
- DATA DISCLOSURE AND ONWARD TRANSFER
We do not disclose Individual’s data and / or personal information without explicit consent, except in specific situations. Sharing of Individual’s data and / or personal information may occur with:
- To Financial Partners: Individual acknowledges that the core of our services involves the disclosure and transfer of your Personal Information to multiple Financial Partners for loan processing, sanctioning and reporting.
- To Legal Authorities: We may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with legal obligations, if any; (b) protect and defend the rights or property of the firm; (c) prevent or investigate possible wrongdoing in connection with the Service; or (d) protect the personal safety of Users of the Service or the public.
- To Service Providers: Third parties assisting with our operations and businesses are contractually bound to protect Individual’s data and / or personal information.
- No Commercial Sale: We do not sell, trade, or rent your Personal Information to third parties for marketing or any other commercial purposes.

- DATA RETENTION POLICY
We will retain Individual’s Personal Information for a period of
180 days from the date of collection, which is necessary to fulfil the purpose for which it was collected, provide our services, resolve disputes, establish legal defences, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws, if any. After this period, Individual’s Personal Information will be securely and permanently deleted from our active systems.
- YOUR RIGHTS AS A DATA SUBJECT
As a User, the Individual shall have the following rights concerning data and / or personal information:
- Right to Access and Review: Individual can request access to and review the Personal Information we hold about the same Individual by contacting our Grievance Officer.
- Right to Correction: Individual has the right to correct or update any inaccurate or deficient Personal Information.
- Right to Data Erasure: Request deletion of data which are no longer required, subject to legal obligations and compliance, if any.
- Right to Grievance Redressal: Lodge complaints with our Grievance Officer of the Data Protection Board.
- Right to Withdraw Consent: Individual has the right to withdraw consent at any time by writing to our Grievance Officer. Please note that withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. Upon withdrawal, we will cease processing your data but may retain it in accordance with Section 7 of the Information Technology Act, 2000.

- DATA SECURITY PRACTICES
We are committed to protecting Individual’s data and have implemented robust security measures in line with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, to protect data and / or personal information of the Individual. These measures include:
- Encryption: All data transmitted between Individual’s browser and our Site is encrypted using Transport Layer Security (TLS). Data at rest is also encrypted.
- Data Storage Location: Data of Indian citizens is stored on servers within India, in consonance with Reserve Bank of India guidelines.
- Access Control: We have implemented strict role-based access controls to ensure that only authorized personnel have access to Individual’s Personal Information on a need-to-know basis.
- Regular Audits: We conduct periodic security audits of our infrastructure to identify and patch vulnerabilities.
- USE OF COOKIES
Cookies are used to improve user experience and analyse traffic. Individual can manage cookies through browser settings, which may impact site functionality.

We will acknowledge receipt of your grievance within 24 hours and will resolve it within 15 days from the date of receipt.
- UPDATES TO THIS PRIVACY POLICY
We reserve the right to update or change our Privacy Policy at any time. We will notify Individual of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top. Individual is advised to review this Privacy Policy periodically for any changes.
- GOVERNING LAW AND JURISDICTION
This Privacy Policy shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal.

- PREAMBLE AND USER'S AFFIRMATIVE AGREEMENT
1.1. Scope and Intent:
This Refund and Cancellation Policy (hereinafter referred to as "Policy") is a legally binding component of the master Terms and Conditions governing the use of the services offered by Nexora Finance Group ("Firm," "we," "us," "our"). This Policy is designed with the express intent of being fully transparent, unambiguous, and exhaustive regarding the non-refundable nature of our Service Fee.
1.2. Affirmative Agreement:
By proceeding to the payment stage and successful payment of the Service Fee, the Individual being the User ("you," "your"), hereby declares and affirms that you have meticulously read, fully comprehended, and unconditionally accepted every clause of this Policy. This action constitutes an electronic signature and a binding agreement to these terms.
- LEGAL DEFINITIONS WITHIN THIS POLICY
2.1. "Service":
It shall mean the fully-automated, one-time, digital administrative process of (a) collecting the User's Personal Information through our secure web portal, and (b) securely transmitting said information to our network of third-party Financial Partners.
2.2. "Service Fee":
It shall mean the non-refundable payment of Rs. 360/- (Rupees Three Hundred and Sixty only) paid by the User to the Company for availing the intended Service.
2.3. "Service Execution Point":
It shall mean the precise moment in time that the User's payment of the Service Fee is successfully confirmed by our payment gateway provider.
- THE NATURE OF THE SERVICE: AN IRREVOCABLE DIGITAL PROCESS
3.1. Instantaneous and Automated:
The Service provided by the Company is a
digital product that is both instantaneous and automated. At the Service Execution Point, our systems are automated to process and transmit your data.
3.2. Irrevocable Nature:
Due to this automated execution, the Service is
irrevocable and non-cancellable once initiated. The resources (including server processing time, API calls, and data handling) are consumed at the moment of execution. Therefore, the Service, once paid for, cannot be "returned" or “cancelled” in the way a physical good can be.
- THE SERVICE FEE: A NON-REFUNDABLE PROCESSING CHARGE
4.1. Fee for Process, Not Outcome:
The User must understand that the Service Fee is payment for the
process of data collection and transmission,
NOT for the
outcome of the loan inquiry. The fee is earned by the Firm at the Service Execution Point, irrespective of any subsequent and / or future events.
4.2. Distinction from Loan Fees:
This Service Fee is neither a loan application fee, nor a security deposit, nor an advance payment on any loan and nor a fee contingent upon loan approval.
- CORE MANDATE: NO REFUND AND NO-CANCELLATION POLICY
5.1. General Rule:
The Service Fee of Rs. 360 /- is
ABSOLUTELY, STRICTLY, AND COMPLETELY NON-REFUNDABLE.
5.2. No Cancellations:
All sales are final. Once the Service Fee is paid, the order for the required Service
CANNOT BE CANCELLED by the User for any reason whatsoever.
- ENUMERATED SCENARIOS OF NON-REFUNDABILITY (EXHAUSTIVE LIST)
To eliminate any ambiguity, if at all, the User explicitly agrees that a refund (either partial or complete) shall not be issued under any of the following circumstances (this list is illustrative and not exhaustive):
- 6.1. Rejection by Financial Partners: If the User's loan inquiry is declined.
- 6.2. Non-Receipt of Offers: If the User does not receive any communication from Financial Partners.
- 6.3. Unfavorable Loan Terms: If the User is dissatisfied with the terms of any loan offer received.
- 6.4. User's Change of Mind ("Buyer's Remorse"): If the User decides they no longer need or want the service after payment.
- 6.5. User Error or Inaccurate Data: If the service fails or the loan is rejected due to incorrect information (e.g., typographical error in PAN, name, or contact details) provided by the User.
- 6.6. Failure to Respond to Lenders: If the User fails to answer calls or respond to communications from Financial Partners.
- 6.7. Perceived Delay: If the User perceives a delay in receiving a response from Financial Partners.
- 6.8. Already Obtained Loan Elsewhere: If the User secures a loan from another source while waiting for a response.
- 6.9. Partial Service Use: The service is considered 100% complete at the Service Execution Point. There is no concept of "partial use" or pro-rata refund.
- POLICY ON CHARGEBACKS AND DISPUTE RESOLUTION
7.1. Illegitimate Chargebacks:
Given the clear and upfront nature of this Policy, the User agrees that initiating a chargeback or payment dispute with their bank or payment provider for the Service Fee on the grounds of "service not rendered" or "service not as described" is an illegitimate action and a breach of this Agreement and the same does not make the Firm liable in any form whatsoever.
7.2. FIRM’S's Right to Action:
In the event of an illegitimate and / or unlawful chargeback by the User, the Firm reserves the right to:
- a) Vigorously defend the chargeback by providing the payment gateway with evidence of this Policy, the User's IP address, timestamps, and proof of the User's affirmative acceptance of these terms.
- b) Report the incident to relevant credit bureaus or fraud prevention databases.
- EXCEPTION PROTOCOL FOR VERIFIED TECHNICAL ERRORS
8.1. Scope of Exception:
The only circumstance under which a refund will be considered is a
verified, acknowledged, demonstrable, and an unrectified technical failure originating solely from the Firm’s systems.
8.2. Double-Charging:
If the User is charged multiple times for the exact same single service instance due to a payment gateway error, the User must contact our support at [support@nexorafinancegroup.com] within 48 hours with transaction IDs for all charges. Upon verification and if found eligible, the duplicate charge(s), less any applicable gateway processing fees, will be refunded to the original payment source within 7-10 banking business days. This is the sole and exclusive exception to the no-refund and non-cancellation rule.
